Terms of Service

Terms of Service of the BUDVAR Sp. z o.o. website, headquartered in Warsaw.

§1

General provisions

  1. The owner of the website "budvar.pl" (hereinafter the "Site") is Budvar Sp. z o.o., headquartered in Warsaw at ul. Postępu 10.
  2. The Site operates under the rules set out in these Terms of Service.
  3. These Terms of Service define the type and scope of services provided electronically via the Site, the rules for their provision, and the complaint procedure.
  4. Every Service User, from the moment of starting to use the Site’s Electronic Services, is obliged to comply with these Terms of Service.
  5. For matters not regulated by these Terms of Service, the following provisions shall apply:
    • Act of 18 July 2002 on the provision of electronic services (Dz. U. No. 144, item 1204, as amended),
    • Act of 30 May 2014 on Consumer Rights (Dz. U. 2014, item 827),
    • Civil Code of 23 April 1964 (Dz. U. No. 16, item 93, as amended) and other relevant provisions of Polish law.
§2

Definitions

  1. CONTACT FORM a form available on the Site allowing the Service User to directly contact the Service Provider.
  2. COMPLAINT FORM a form available on the Site allowing the Service User to submit a complaint.
  3. WINDOW CONFIGURATION a tool for configuring windows, HS doors, doors, roller shutters, accessories and custom products.
  4. PARTNER SECTION a service available on the Site allowing a Service User who is a business Partner of Budvar to contact the Service Provider. It is a tool created to improve cooperation.
  5. SERVICE PROVIDER BUDVAR Sp. z o.o., registered office address: ul. Postępu 10, 02-676 Warszawa, mailing address: ul.   6. SERVICE USER a natural person, legal person or organizational unit without legal personality to which the law grants legal capacity, using an Electronic Service.
  7. ELECTRONIC SERVICE a service provided electronically by the Service Provider to the Service User via the Site.
§3

Type and scope of electronic services

  1. The Service Provider enables the use of the following Electronic Services via the Site:
    • Use of the Contact Form,
    • Use of the Complaint Form,
    • Use of the Partner section,
    • Use of the Window Configuration.
  2. The provision of Electronic Services to Service Users is carried out under the conditions set out in the Terms of Service.
  3. All product images and color samples published on the Site are presented by Budvar with the utmost care, but they are purely informational and may differ slightly from the actual images or colors of the products, particularly depending on the type and settings of the User’s computer. Consequently, any minor discrepancies in color or image of products published on the Site do not constitute grounds for complaint. The properties of ordered products shall be determined primarily by the data specified in the agreement concluded with Budvar, including the order specification forming an integral part of such agreement. Budvar shall not be liable for any damages resulting from sole reliance on the content of the website.
  4. All photos published on the website are for preview purposes only and the actual appearance of the products may differ.
§4

Terms of provision and contract conclusion

  1. The provision of Electronic Services specified in Chapter III, point 1 of the Terms of Service by the Service Provider is free of charge.
  2. Technical requirements necessary for cooperation with the IT system used by the Service Provider:
    • a computer with Internet access,
    • access to email,
    • an Internet browser,
    • enabling cookies and JavaScript in the Internet browser.
  3. The Service User is obliged to use the Site in a manner consistent with the law and good practices, with respect for personal rights and intellectual property rights of third parties.
  4. The Service User is obliged to enter data consistent with the facts.
  5. The Service User is prohibited from providing content of an unlawful nature.

The Service Provider uses a "cookies" mechanism, described in more detail in the Privacy Policy.

§5

Terms for contract termination

Termination of the Electronic Service contract:

  1. A contract for the provision of an Electronic Service of a continuous and indefinite nature (e.g. use of the Newsletter) may be terminated.
  2. The Service User may terminate the contract with immediate effect and without giving reasons by sending an appropriate declaration via email to: windows@budvarcentrum.eu
  3. The Service Provider may terminate the Electronic Service contract if the Service User breaches the Terms of Service or if the User fails to comply with applicable law.
  4. Termination results in the cessation of the legal relationship with effect for the future.
  5. The Service Provider and the Service User may terminate the Electronic Service contract at any time by mutual agreement.
§6

Contact form

The contact form service is provided exclusively to persons who:

  • have provided their data in the contact form available on the budvar.pl website,
  • have consented to the processing of their personal data by the Service Provider,
  • have entered into a contract for the provision of electronic services by completing the form and sending the message.

The provision of the service by the Service Provider consists in sending a reply to the Service User at the indicated email address.

§7

Complaint form

The complaint form service is provided exclusively to persons who:

  • have provided their data in the contact form available on the budvar.pl website,
  • have consented to the processing of their personal data by the Service Provider.

The Service Provider provides the electronic service by enabling remote contact. The Service Provider will respond to the complaint thus submitted by electronic means. The Service Provider will process the provided data solely for the purpose of handling the complaint.

§8

Partner section

A service available on the Site. It is a tool created to improve cooperation. It will contain commercial and marketing information. The Partner section is dedicated solely to Partners of Budvar Centrum who have consented to the processing of data contained in the GDPR-compliant information clause. Access is only possible after logging in. It is a Customer Area where additional data, news and materials are available.

§9

Window configurator

This is the section where the User can easily configure windows, HS doors, doors, roller shutters, accessories and custom products. The exact operation and rules of the configurator are contained in a separate set of regulations.

§10

Complaint procedure

Complaints relating to the provision of Electronic Services by the Service Provider:

The Service User may submit complaints related to the provision of Electronic Services via the Site by email to: windows@budvarcentrum.eu

In the above email, please provide as much information and circumstances regarding the subject of the complaint as possible, in particular the type and date of the irregularity and contact details. The information provided will significantly facilitate and accelerate the handling of the complaint by the Service Provider.

The Service Provider shall handle the complaint promptly, no later than within 14 days.

The Service Provider’s response to the complaint is sent to the email address of the Service User given in the complaint submission or by another method indicated by the Service User.

§11

Data protection

Personal data (such as first name, last name and email address) provided to Budvar via this website will be used solely in accordance with the provisions of the Privacy Policy. The data controller is the Service Provider. The full text of the information regarding data processing is contained in the Privacy Policy.

§12

Intellectual property

All content published on the Site is protected by copyright law and is the property of Budvar Centrum. The Service User bears full responsibility for any damage caused to the Service Provider resulting from the use of any content of the Site without the Service Provider’s consent.

Any use by anyone, without the express written consent of the Service Provider, of any element of the content of the Site constitutes infringement of the Service Provider’s copyright and gives rise to civil and criminal liability.

§14

Final provisions

Contracts concluded via the Site are entered into in accordance with Polish law.

In the event of any part of the Terms of Service being inconsistent with the applicable law, the relevant provisions of Polish law shall apply in place of the contested provision of the Terms of Service.

Budvar reserves the right to make future changes and modifications to this legal notice. Budvar will announce the intention to introduce changes on its website with 7 days’ notice.

This legal notice and the use of this website by its visitors are governed by Polish law.
